1. LIMITATION OF LIABILITY.

You acknowledge that Magento Enterprise Edition, Magento Professional Edition and Magento Community Edition are not Sitesquad products, and that Sitesquad is not liable for problems attributable to the Magento code base (“Magento Bugs”). You may contract Sitesquad to attempt resolution of Magento Bugs, which could include functionality that does not work as claimed by Magento, Inc. 1.4 Third-Party Products, Services and Work. You acknowledge that Sitesquad does not warrant and disclaims all liability for issues attributable to third-party software extensions, your hosting service and/or other Magento work performed to your Magento store by other developers. You acknowledge third-party products, services and customizations could adversely affect Sitesquad performance. You agree to these conditions.
2. PERFORMANCE OF SERVICES
2.1 Sitesquad Troubleshooting for a Day, Sitesquad Consulting for a Day. Sitesquad does not guarantee it will resolve your Magento problems or satisfy your consulting needs in the time provisioned for these servicses. All sales for these services are final. We do not issue any refunds for these services. You agree to these conditions.
2.2 Sitesquad Live Troubleshooting, Sitesquad Live Consulting. Sitesquad does not guarantee it will be able to resolve your Magento problem or satisfy your Magento consulting needs within the 1-hour provisioned for theses service. All sales for these services are final. We do not issue any refunds for these services. You agree to these conditions.
2.3 Sitesquad Magento Upgrades. Sitesquad does not guarantee it will be able to upgrade your live Magento store for any quoted price, either listed on this website or an written estimated. Additional monies may be required to repair third-party extensions and customizations which are found to be inoperable with new versions of Magento. Sitesquad also does not warrant your store from bugs introduced in the version of Magento your store is upgraded to. All sales for this service are final. We do not issue any refunds for this service. You agree to these conditions.
2.4 Sitesquad Help Desk, Sitesquad Open Help Desk. Sitesquad does not guarantee the support time you purchase as part of these services will be sufficient to meet your needs. Pursuant to Section 1 (1.3, 1.4), Sitesquad does not provide warranty or un-metered support for problems attributable to Magento bugs, third-party extensions, other hosting services and/or Magento work performed to your website by Sitesquad or other parties. Sitesquad may, but is not obligated to and does not by default provide warranty or un-metered support terms for work it completes for your website. Sitesquad Help Desk and Sitesquad Open Help Desk are open Monday through Friday, 9:00 AM ET to 6:00 PM ET. Emergency requests for support outside these times is subject "Off-Hours" pricing, unless root causes are related to Sitesquad Hosting. You agree to these conditions.
3.1 Prices. All prices associated to professional services sold on this websites, including but not limited to troubleshooting, consulting, design, programming, and support services, are estimated fees only and NOT fixed-priced guarantees. You agree to this condition..
3.2 Governing Law. This Terms of Services Agreement and the rights and obligations of the parties hereunder shall be construed in accordance with and shall be governed by the laws of the Commonwealth of Pennsylvania, excluding its conflict of law rules, and applicable federal law.
